By accessing or using SwagYards's website (swagyards.com) and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

We reserve the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the modified terms.

2. Services Description

SwagYards provides custom apparel printing services including, but not limited to, DTF printing, embroidery, sublimation, and laser engraving. We customize apparel and products with designs provided by customers or created using our design tools.

3. Account Registration

To place orders, you may need to create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Orders and Payment

Order Acceptance

All orders are subject to acceptance by SwagYards. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing, or issues with payment.

Pricing

All prices are in US dollars and are subject to change without notice. Prices do not include shipping, handling, or applicable taxes unless otherwise stated.

Payment

Payment is due at the time of order unless otherwise arranged for approved business accounts. We accept major credit cards, PayPal, and bank transfers for qualifying orders.

5. Artwork and Design

Customer-Provided Artwork

By submitting artwork, you represent and warrant that:

• You own the rights to the artwork or have permission to use it
• The artwork does not infringe on any copyright, trademark, or other intellectual property rights
• The artwork does not contain illegal, defamatory, or objectionable content

Prohibited Content

We reserve the right to refuse any order containing:

• Copyrighted material without proper authorization
• Trademarked logos or brands without proper licensing
• Hate speech, discriminatory content, or offensive material
• Illegal content or content promoting illegal activities
• Pornographic or excessively violent imagery

Artwork Quality

We recommend high-resolution files for best print quality. We are not responsible for poor print quality resulting from low-resolution artwork submitted by the customer.

6. Production and Shipping

Turnaround Time

Standard production time is 5-7 business days after artwork approval. Rush options are available for additional fees. Production times do not include shipping transit time.

Shipping

We ship via major carriers (UPS, FedEx, USPS). Shipping times and costs vary by destination. We are not responsible for delays caused by carriers, customs, or circumstances beyond our control.

Risk of Loss

Risk of loss and title for products pass to you upon delivery to the carrier.

7. Returns and Refunds

Quality Guarantee

We stand behind the quality of our work. If you receive a defective product or one that does not match your approved proof, we will reprint the order or issue a refund at our discretion.

Return Policy

Due to the custom nature of our products:

• Custom printed items cannot be returned for buyer's remorse
• Quality issues must be reported within 7 days of delivery
• Photos of defects are required for all quality claims
• Original packaging should be retained when possible

Color Variations

Due to variations in monitors, fabric types, and printing processes, slight color differences between on-screen previews and printed products may occur. These variations are not considered defects.

8. Intellectual Property

All content on our website, including but not limited to text, graphics, logos, and software, is the property of SwagYards or its licensors and is protected by intellectual property laws.

You retain ownership of artwork you submit. By uploading artwork, you grant us a limited license to reproduce and use the artwork solely for fulfilling your order.

9. Limitation of Liability

To the maximum extent permitted by law:

• SwagYards shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount paid for the specific order in question
• We are not liable for delays or failures due to circumstances beyond our reasonable control

10. Indemnification

You agree to indemnify and hold SwagYards harmless from any claims, damages, losses, or expenses arising from your use of our services, violation of these terms, or infringement of any intellectual property or other rights of third parties.

11. Dispute Resolution

Any disputes arising from these terms or your use of our services shall be:

• First attempted to be resolved through good-faith negotiation
• Subject to binding arbitration in Los Angeles County, California
• Governed by the laws of the State of California

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

13. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and SwagYards regarding the use of our services.
